UPDATE TO CPSC RECALL 14-175 ISSUED MAY 13, 2014

This communication seeks to provide further clarification to and information relevant to Recall 14-175 issued May 13, 2014 by the Consumer Product Safety Commission (“CPSC”).

Misty 2.5 High Pressure Personal Misters

Misty Mate is pleased to report that of the approximately 9,000 affected units, Misty Mate has, to date, recovered and destroyed 8,779 – a 98% recovery.

BACKGROUND

Misty Mate and CPSC worked together on this recall and press release, out of an abundance of caution, to address any potentially existing issues with the affected product in the stream of commerce. The product in question, as stated in the press release, was sold exclusively at Hibbett Sports (“Hibbett”) locations from May 2013 through July 2013. After a potential hazard was raised, Misty Mate proactively took action to identify and remove the product from stores, cooperated with CPSC in issuing a voluntary recall and took all necessary steps to limit and prevent any further risk to the public.

POTENTIAL FOR RISK

When used, the recalled product will most likely function to specification but can shatter when pressurized and dropped onto a hard surface. The issue has been isolated to a specific run of product that was produced exclusively for – and shipped directly to – Hibbett. No other Misty Mate products have been affected by this recall.

RECOVERY & RESULTS

If you currently own a Misty Mate misting product purchased from Hibbett from May 2013 through July 2013, please return to Misty Mate for a full refund.
