ELIGIBILITY
The following products are eligible for the described FOUR (4) YEAR LIMITED WARRANTY offer:

To activate your warranty, you must first register your product with Misty Mate. Simply enter the product key located on the back of your Warranty Card at www.mistymate.com to register.

WARRANTY COVERAGE

Misty Mate’s warranty is enforced by the terms below:

Misty Mate warrants all Misty Mate products against defects in materials and workmanship under normal operating conditions and suggested uses for a period of FOUR (4) YEARS. This FOUR (4) YEAR period begins at the date of production (“Warranty Period”). This limited warranty is only valid for eligible, registered Misty Mate products and to the original purchaser. If a defect arises and a valid claim is received by Misty Mate from the original purchaser within the Warranty Period, the company will exchange the defective part for a new functional part. The originally purchased product still assumes and continues the FOUR (4) YEAR Warranty Period that began at the date of production. When a defective part is exchanged, the replacement part becomes your property and the defective item is again Misty Mate’s property. You are responsible for the removal and installation of the product, if applicable.

Misty Mate reserves the right, at its sole discretion to change, modify, add or remove portions of its Warranty Coverage and policies at any time.

EXCLUSIONS AND LIMITATIONS

This Limited Warranty applies only to Products that have been manufactured by Misty Mate. It must be identifiable by the Misty Mate trademark, trade name or logo. This Limited Warranty does not apply if the Product (a) has been altered, serviced, upgraded or expanded by anyone who is not a representative of Misty Mate, (b) has been installed, operated, repaired or maintained that does not follow the instructions for installation and usage supplied by Misty Mate, (c) has been damaged by operating outside guidelines for which it was designed and intended by Misty Mate, (d) has been damaged caused by accident, misuse, stress, negligence, fire, water damage or other external causes, (e) has been modified to significantly alter functionality or capability (f) if any Misty Mate logos, trademarks have been removed or defaced (g) if the product warranty has not been registered with Misty Mate. Misty Mate’s Warranty Coverage shall not exceed 2 claims, the amount paid by the customer for the product or the FOUR (4) YEAR Warranty Period.

NO OTHER WARRANTIES

Misty Mate limits its coverage under the FOUR (4) YEAR LIMITED WARRANTY policy and does not recognize or offer any form of an Implied Warranty. No warranties shall apply after the maximum number of claims has been made by the customer or after the Warranty Period; whichever is sooner.

OBTAINING WARRANTY SERVICE

Please review the Directions For Use provided with your Product or view our online version at http://www.mistymate.com/directions.html before seeking warranty service. If the part is still not functioning properly, and falls within the FOUR (4) YEAR Warranty Period as described above, please contact Misty Mate via telephone or email as soon as possible in order to prove the item is defective and obtain a Claim Number, if applicable. Be sure to provide your Name, Address, Telephone Number and E-mail Address when contacting Misty Mate. CLAIMS WILL NOT BE PROCESSED WITHOUT WARRANTY REGISTRATION. Misty Mate will pay for Best Means Ground Shipping at its discretion to return the replacement part or product to you. Customers located outside the United States are responsible for all shipping and handling charges.

OBTAINING SERVICE OUTSIDE OF WARRANTY TERMS

Misty Mate is available for customer service, assistance and support at any point in time during the ownership of your Misty Mate Product. If the Product is no longer covered under the terms of Misty Mate’s FOUR (4) YEAR LIMITED WARRANTY policy and is malfunctioning, please review the Misty Mate Directions For Use provided with your Product or view our online version at http://www.mistymate.com/directions.html for troubleshooting. In addition, a Misty Mate Customer Service Representative can provide you with prompt repair suggestions on a case-by-case basis via telephone or email. If new parts are needed for Products outside of the FOUR (4) YEAR LIMITED WARRANTY terms, they can be purchased from the Misty Mate website at http://www.mistymate.com or by phone at 1-800-233-6478.

ALL MISTY MATE POLICIES AND AGREEMENTS ARE GOVERENED BY LAWS OF THE STATE OF ARIZONA. ANY LITIGATION OR DISPUTES IN CONNECTION WITH MISTY MATE POLICIES AND AGREEMENTS SHALL BE FILED IN EITHER THE UNITED STATES DISTRICT COURT FOR THE DISTRICT OF ARIZONA – PHOENIX DIVISION OR THE SUPERIOR COURT OF ARIZONA IN MARICOPA COUNTY, AND THE PARTIES HEREBY CONSENT AND VOLUNTARILY SUBMIT THE PERSONAL JURISDICTION AND VENUE OF THOSE COURTS IN CONNECTION WITH ANY SUCH LITIGATION OR DISPUTE.
